This Release of Liability Agreement (the “Agreement”) is made between the individual receiving services (the “Patient”) and the HersheyDispensary.com caregiver(s)(the “Caregiver”). By using the services provided, the Patient acknowledges and agrees to the terms and conditions outlined below:

1. Acknowledgment of Services

The Patient acknowledges that the Caregiver provides services strictly limited to the delivery of medical marijuana and may offer product recommendations based on publicly available information. The Caregiver does not manufacture, produce, or control the quality of any products delivered and assumes no responsibility for their effectiveness, safety, or intended use.

2. Product Quality Disclaimer

The Patient acknowledges and agrees that the Caregiver is solely responsible for delivering the product but does not have any control over its manufacturing, cultivation, storage, or packaging. The Caregiver makes no warranties, express or implied, regarding:

  • The product’s quality, potency, or safety.
  • Any potential adverse effects or reactions that may result from its use.
  • The accuracy of labeling, ingredients, or information provided by the dispensary or manufacturer.

The Patient releases the Caregiver from any liability related to defects, contamination, misrepresentation, or other issues concerning the quality or condition of the product.

3. Responsibility for Delivered Products

The Patient acknowledges that if they are not present at the time of delivery, the product will be left at the designated location specified by the Patient. The Patient assumes full responsibility for:

  • Ensuring the security and safety of the chosen delivery location.
  • Any loss, theft, or misplacement of the product after delivery has been completed.
  • Any product degradation due to improper storage conditions (e.g., exposure to heat, cold, or moisture).

The Caregiver is not liable for any damages, losses, or adverse effects resulting from the Patient’s chosen storage location or conditions after delivery.

4. Indemnification

The Patient agrees to indemnify, defend, and hold harmless the Caregiver, its employees, agents, and affiliates from any claims, demands, liabilities, damages, costs, or expenses (including legal fees) arising from:

  • The Patient’s use, possession, or storage of medical marijuana.
  • Any third-party claims resulting from the delivery of the product to the designated location.
  • Any violations of state or local laws related to medical marijuana use, possession, or storage.

5. Compliance with Pennsylvania Laws

The Patient understands that medical marijuana use is governed by Pennsylvania state laws and regulations. The Caregiver operates strictly within the boundaries of these laws and assumes no responsibility for any legal consequences arising from improper possession, use, or transport of medical marijuana by the Patient.
